These Terms & Conditions (the “Terms”) govern your access to and use of vitiumtattoo.com (the “Website”), operated by VITIUM LTD, and any order you place through it. By using the Website you agree to these Terms. If you do not agree, please do not use the Website.

1. About us

VITIUM operates through two companies. Which one you buy from depends on where your order ships, and it is that company you contract with:

Both are reachable at info@vitiumtattoo.com. In these Terms, “we” and “us” mean whichever of the two is the seller for your order.

2. Use of the Website

You agree to use the Website only for lawful purposes and in a way that does not infringe on the rights of others, restrict or inhibit anyone else’s use, or harm the Website’s operation. You must not attempt unauthorised access, introduce malware, or scrape content without permission.

3. Buying from this Website

You can buy VITIUM directly on this Website if you are in the United Kingdom or the United States. Payment is taken securely by Stripe; we never see or store your full card details.

Placing an order is an offer to buy. A contract forms when we send your order confirmation email. If we cannot fulfil an order — for example the item sells out between your payment and dispatch, or the delivery address falls outside the area we can ship to — we will cancel it and refund you in full. We may also decline or cancel an order where we reasonably suspect fraud, or where a price or description was obviously wrong.

Prices are shown in the currency for your region and include VAT where applicable. United States prices are shown excluding sales tax, which is calculated at checkout. Delivery costs are shown before you pay.

Orders are dispatched by Amazon’s fulfilment network in unbranded packaging. Delivery estimates are estimates, not guarantees.

4. Returns & refunds

Direct orders can be returned within 30 days of delivery if the jar is unopened and unused with its seal intact; you cover return postage for a change of mind. Faulty, damaged, or incorrect items are always put right at our cost, and your statutory cancellation rights are unaffected. The full policy, including how to start a return, is in our Returns & Refunds policy, which forms part of these Terms.

5. Buying elsewhere

VITIUM is also sold on Amazon (United States and United Kingdom) and TikTok Shop (United Kingdom). Customers outside the UK and US are directed to Amazon, as we cannot yet ship directly to those countries.

Purchases made on those marketplaces are governed by that marketplace’s own terms, privacy notice, returns and dispute policies — not by this section or our Returns policy. If you bought on Amazon or TikTok Shop, start any return or refund there.

6. Wholesale enquiries

Studios and retailers can apply for wholesale through the form on our Partners page. Submitting an application does not create a contract. We review applications on a case-by-case basis and will respond with next steps, pricing, and our wholesale terms if we invite you to proceed.

7. Content & intellectual property

All content on the Website — including text, photography, illustrations, video, trade marks, logos, and product designs — is owned by or licensed to VITIUM LTD and is protected by United Kingdom, European Union, and international intellectual property laws. You may view and download content for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

8. No medical advice

Content on the Website (including blog posts, product descriptions, and aftercare guides) is provided for general information only. It is not medical, dermatological, or professional advice. If your tattoo shows signs of infection, severe irritation, or any reaction that concerns you, seek advice from your tattoo artist or a qualified medical professional. VITIUM is not liable for decisions you make based on Website content.

9. Accuracy of content

We take reasonable care to keep information on the Website accurate and up to date, but we make no warranties or representations about completeness or accuracy. Ingredient lists and formulations may be updated; always refer to the label on your product for the authoritative list.

10. Third-party links

The Website may include links to third-party sites (for example Amazon product listings, social media). We do not control these sites and are not responsible for their content, products, or privacy practices.

11. Limitation of liability

To the maximum extent permitted by law, VITIUM LTD and VITIUM LLC, their directors, employees, and agents are not liable for any indirect, consequential, special, or punitive damages arising from your use of the Website, including lost profits, lost data, or business interruption — whether in contract, tort, or otherwise — even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

12. Indemnification

You agree to indemnify and hold VITIUM LTD and VITIUM LLC harmless from any claim, loss, or damage (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Website.

13. Governing law & jurisdiction

Which law applies depends on which company sold to you (see section 1).

Orders sold by VITIUM LTD (United Kingdom and elsewhere), and use of the Website generally, are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, except that if you are a consumer resident in another part of the United Kingdom or the European Union you may also bring proceedings in the courts of your country of residence, as applicable law allows.

Orders sold by VITIUM LLC (United States) are governed by the laws of the State of Wyoming and applicable United States federal law. If you are a consumer, nothing here removes your right to bring proceedings in the courts of your own state, or the protection of the consumer laws of the state in which you live.

14. Changes to these Terms

We may update these Terms from time to time. The “effective” date at the top tells you when they were last revised. Continued use of the Website after a change means you accept the new Terms.
